Huda Beauty has secured a significant legal victory in India, with the District Commercial Court in New Delhi issuing a permanent injunction against Vision Enterprises for importing counterfeit cosmetics. 

The ruling followed a seizure by Customs at Kolkata Port, where imitation Huda Beauty products were intercepted. Upon examination, the brand confirmed these goods were fake and initiated legal action.

The court found Vision Enterprises guilty of trademark infringement and granted a permanent injunction that prohibits the import, sale, and advertisement of products bearing identical or deceptively similar marks to Huda Beauty’s registered trademarks. 

In addition to this, Indian Customs has been instructed to destroy the seized counterfeit items under the Intellectual Property Rights (Imported Goods) Enforcement Rules, 2007.

In its submission, Huda Beauty presented evidence of its valid trademark registrations, strong international presence, and authorised retail partnerships in India, including collaborations with platforms such as Nykaa and Sephora. The defendant, Vision Enterprises, did not contest the allegations or offer a defense in court.

This ruling is a milestone in strengthening India’s legal and customs framework against counterfeit goods, especially in the beauty and cosmetics sector. As fake products continue to pose risks to consumer health, brand integrity, and economic interests, the court’s decision underscores the importance of rigorous enforcement to protect both brands and buyers.

The outcome not only protects Huda Beauty’s reputation but also sets a legal precedent for other global beauty companies combating counterfeit imports in India’s growing beauty market.
